Adalpur Encounter: Bombay High Court Suspected of foul play, Grill Police Achi-News

Guwahati: The Bombay High Court on Wednesday, September 25, remanded the Mumbai Police for the killing of Adalpur sexual assault accused Akshay Shinde, who was shot dead in a retaliatory firing on Monday.

A bench of Chief Justices Mohita Dera and Prithviraj Chavan heard a plea moved by Shinda’s father for investigation by a Special Investigation Team (SIT) in the meeting.

The court said that it appeared to be foul play and the event could not be called a “meeting”.".

The court investigated the police’s claim that Shinde grabbed a policeman’s weapon, prompting the officers to open fire on him.

Police said Shinde, accused of sexually abusing two girls at a school in Delapur, was being taken to Dalpur from Taluja Jail when he grabbed Assistant Superintendent of Police (API) Nilesh Moore’s gun and fired at the escorting police team, injuring three policemen. Shinde was then killed in retaliatory firing by the police.

The court also criticized the officers for their failure to protect the weapon. He added that usually the accused should be shot below the knee in such circumstances. "How could we believe that the police, who were trained in shooting, failed to overpower the accused," asked the court.

He emphasized the fact that the police could overpower Shinde and hence the police’s claim that it was an encounter seemed doubtful. "It cannot be defined as a meeting. This is not a meeting." the city of the court.

It was also said that the police should verify whether Shinde had used a firearm in the past. "If he pulled.. he must have had some idea.. hard to imagine.. unless the safety was kept open," the city of the court. "It’s hard to believe. Apparently, there is foul play. A layman can’t shoot a gun, unlike a gun that any Tom, Dick, and Harry can make. A weak man cannot load a gun because he needs strength."

Two kindergarten students were allegedly sexually abused by Akshay Shinde, 23, at a Badalpur school in August. He was later arrested by the police and sent to detention.

On September 23, Shainda was again taken into custody from Taluja Jail in connection with a sexual abuse case filed by his wife. While being taken to Thane, he reportedly grabbed a police officer’s gun and wounded him before being fatally shot by another officer in the car.

The investigation in the case has been transferred to the CID.

We want an impartial investigation even though the police are involved," emphasized the bench. The issue will be discussed further on October 3.
