SC favors release of 96-year-old secular man in terror case: Continued imprisonment like death penalty – Amar Ojala Hindi News Live Achi-News

The Supreme Court upheld the acquittal of a 96-year-old ailing convict, who had served a life sentence and is now on parole, in the 1993 Rajasthan train blast case. The Supreme Court bench comprising Justice Abhay S Oka and Justice Ujwal Bhuyan, while hearing the petition of bomb blast case convict Habib Ahmed Khan, directed the Rajasthan government to look at it from a humanitarian perspective.

It is worth noting that Habib Ahmed Khan demanded a permanent release on parole from the Supreme Court with reference to his deteriorating health and age. The petitioner’s lawyer told the Supreme Court that he has been in prison for more than 27 years. He was subsequently paroled three times. From time to time this court extends the third suspended sentence. In such a situation, he should be given permanent parole.

The bench then, after perusing Habib Ahmed Khan’s medical reports, asked Additional Solicitor General Vikramjit Banerjee, representing Rajasthan, to consider his apology and look at the matter from a human rights perspective. The bench also said, ‘Just look at his medical report, where will he go? This is the worst. Yes, he has been convicted of a terrorist crime but he has not been given the death penalty. For him, continued imprisonment is tantamount to a death sentence.

To this, the ASG said that the convicted person would have to apply to the state government for a sentence to be expunged, but in the current case his conviction for a terrorist offense would be an obstacle. To this, Justice Bhuyan said that at the age of 96, Khan is just counting his days and the law cannot be so insensitive. Additional Attorney General Vikramjit Banerjee then said that this court has all the powers in the world and if it has to use the power under Article 142 of the Constitution for exemption, then I plead not to do so. Only the state government can grant this exemption. After hearing the arguments, the commission asked Additional Solicitor General Vikramjit Banerjee to advise whether Khan can be granted immunity or permanent parole. The bench later registered the matter after two weeks.

Let us tell you that Habib Ahmed Khan was arrested in 1994 in connection with the serial train blasts in 1993. In 2004, the Ajmer High Court convicted him along with 14 others under the Terrorist and Disruptive Activities (Prevention) Act (TADA). In 2016, the Supreme Court upheld Khan’s conviction and life sentence. However, the Supreme Court later granted him parole in 2021. At that time he was put in Jaipur Jail.
