answer- Advocate Ravi Ranjan Mishra says the traffic police have the right to stop the drivers and see the vehicle documents or ask questions. If you are asked to stop, it does not mean you have done anything wrong. Traffic police can stop drivers even just for routine questioning. So, if you have not broken any traffic rule and the traffic police stop you, then keep these things in mind –

Question – What powers do the traffic police have?

answer- Like drivers, traffic police also have certain special powers by law, which they use to enforce traffic rules or maintain road safety. Traffic police can fine or impound the vehicle for traffic violations and incomplete vehicle documents. Apart from this, the traffic police can also arrest in case of indecency.

Question: How can the traffic police not behave with the drivers?

answer- If you follow the traffic rules then there is no need to worry about the police. Traffic police can stop you and question you or ask for appropriate documents, but this does not mean that the policeman should misbehave with the driver in the name of checking the vehicle. By doing this, the driver can complain against the traffic policeman to higher authorities.

Question – Can a policeman take your car or bike keys?

answer- If you cooperate with the check, you can refuse the police officer to take the keys. No police officer can seize two or four wheeler keys. In this regard, a Right to Information (RTI) was filed by advocate Pawan Parikh, in response to which it was made clear that a traffic police officer, irrespective of his rank, does not have the right to remove the keys from the vehicle forcefully. .

Question – If a challenge is given for breaking traffic rules, then what things should be kept in mind?

answer- A Challan is issued by the traffic police for violating traffic rules or the absence of official documents. It serves as legal proof of the offence, with provisions for the amount of the fine. In the case of a challan, it is important to have its receipt as delay in paying the challan can result in a higher fine, license suspension or vehicle impoundment.

If the challan for your vehicle has been issued by the traffic police, then definitely check these things in the challan. Such as-

  • Check every detail given in the challan carefully. Whether the amount of the fine is written according to the traffic rule you have broken or not.
  • Please also confirm the details of the court where the challenge is to be settled.
  • Try to pay your invoices promptly. This often results in a reduction in the amount of the fine. Many states also have the facility to pay challan online to facilitate the process.

Question – Where can I complain about the traffic policeman?

answer- Advocate Ravi Ranjan Mishra says that if a traffic policeman shows any kind of rudeness or misbehavior with you, then you should behave carefully and politely with him on the spot. During this period, remember the name and number written on the batch of traffic policeman. After this, you can make a written complaint about the matter by sending an email to DCP Traffic or any other senior officer or by going to their office.

Question – Who is exempt from not wearing a helmet?

answer- According to the Helmet Regulation and Law in India, wearing a helmet is mandatory for every two-wheeler in the country. According to section 129 of this rule, driving a two-wheeler without a helmet can lead to a fine of Rs 5000 and the driving license can be suspended for three years. However, if a Sikh wears a turban while riding a bicycle or scooter, he is allowed to ride the bicycle without a helmet.

Apart from these, if a person has had any surgery on his neck, and he has difficulty wearing a helmet because of that, then he is also allowed not to wear a helmet. However, for this the person will have to show documents relating to the surgery as proof.
