Arvind Kejriwal will remain in jail as the Delhi High Court stays the bail order Achi-News

GUWAHATI: The Delhi High Court stayed the trial court’s order granting bail to Chief Minister Arvind Kejriwal in the controversial excise policy case. The stay was ordered by Justice Sudhir Kumar Jain in response to a petition by the Enforcement Directorate (ED), which challenged the trial court’s earlier bail order.

Jain criticized the trial court’s approach, noting that the vacation judge did not properly consider the extensive material on record and the findings of the ED. The Supreme Court found the trial court’s comments, indicating that it had not reviewed the full record, to be “completely unjustified.”

Such comments indicated a lack of proper application of judgment to the particulars of the case, according to Jain. The High Court of Justice accepted the defense attorney’s argument that she was not given a sufficient opportunity by the trial judge to voice his arguments. This finding was decisive in the decision to delay the bail order.

Kejriwal was originally granted bail by the trial court on June 20. The ED appealed this decision on June 21, seeking an urgent stay on the bail order.

Kejriwal moved to the Supreme Court, challenging the Delhi High Court’s interim stay. A vacation bench headed by Justice Manoaj Misra discussed the matter on June 24 and noted that the High Court had decided to withdraw the verdict on the ED’s stay plea. "A bit unusual." Usually, stay orders are issued immediately after the hearing instead of reservations.

Kejriwal was arrested by ED on March 21 on charges of excise policy. He was granted interim bail by the Supreme Court in May due to the general election, but surrendered on June 2 after the interim period expired. The trial court’s June 20 bail order strongly criticized the ED, pointing to bias in its actions against Kejriwal and citing the absence of direct evidence regarding the alleged proceeds of crime.
