Patna (June 20): The Patna High Court has given a shock to the Nitish government. 65% reservation for EBC, SC and ST was cancelled. The Patna High Court struck down Bihar’s detention law. Bihar government has increased the reservation for Backward Classes, Most Backward Classes, Scheduled Castes and Scheduled Tribes from 50% to 65%. This was rejected by the High Court.

The Patna High Court heard the petitions filed by Gaurav Kumar and others in this case. After the hearing, the High Court reserved the judgment for March 11, 2024, which was announced today. A division bench headed by Chief Justice KV Chandran conducted a lengthy hearing on the petitions of Gaurav Kumar and others. Advocate General PK Shahi argued in favor of the state government. He told the court that the state government has given this reservation because these classes are not adequately represented. The state government has not provided this provision commensurately.

A challenge to the state government

In these petitions, the law passed by the state government on November 9, 2023 has been challenged. In this regard, SC, ST, EBC and other backward classes get 65% reservation, while general category candidates can be given government service only for 35% posts.

Abolishing 10 per cent reservation for EWS in the general category is in violation of Section 14 and Section 15 (6) (b) of the Constitution of India, advocate Dinu Kumar told the court in earlier hearings. He said that after the caste survey, this reservation decision was made on the basis of caste ratio and not on the basis of adequate representation in government jobs.

He said that in the Indira Swahani case, the Supreme Court had imposed a 50 per cent restriction on the detention limit. The issue of caste survey is currently being heard in the Supreme Court. Based on this, the state government’s decision was challenged in the Supreme Court where the state government increased the retention limit in government jobs from 50% to 65%.

Because of this, the Patna High Court set aside the state government’s decision to increase the reservation limit for these categories from fifty to sixty-five percent.
