On May 29, the Supreme Court upheld the decision of the Delhi High Court to demolish the illegally constructed Shiva temple. A vacation bench of Justice Sanjay Kumar and Justice Augustine George Massiah declined to interfere with the Delhi High Court order. In fact, 29 of the Delhi High Court gave permission to demolish a Shiva temple located in the submerged area of Yamuna.

While ordering the demolition of the ancient Shiva temple, the Delhi High Court said that Lord Shiva did not need the court’s protection. It is “we the people” who seek the protection and blessings of Lord Shiva. Lord Shiva will be more pleased if the Yamuna river bed and flood plains are freed from encroachment and illegal construction. Lord Shiva will be more pleased if the Yamuna river bed and flood plains are freed from encroachment and illegal construction. The Delhi High Court said that Lord Shiva does not need anyone’s protection as it refused to make him a party to a petition related to the removal of a temple built without permission on the banks of the Yamuna river.

The petitioner, Farchin Shiv Mandir of another committee, claimed that the temple is a center of spiritual activities, which is regularly visited by 300 to 400 Hasidic followers. The petition claims that the company was registered in 2018 to maintain transparency, accountability and responsible management of the temple’s assets. The High Court said that the disputed land is for a greater public interest, and the petitioner company cannot claim any inherent right to seize it and continue to use it. This land is under the regional development plan for Zone-O approved by the Ministry of Urban Development. He said that the petitioner company has miserably failed to produce any document regarding its ownership, rights or interest in the land and there is no evidence that the temple has any historical significance.

The bench said, “Where is the proof of the ancient temple? The ancient temples were not built with cement and paint, but with rocks. Hearing the case on Friday, a vacation bench of justices PV Sanjay Kumar and Augustine George Massiah said there is no flaw in the order The Appellate High Court and Judge Kumar questioned the petitioners committee’s right to challenge the demolition “How can another be built in the flood plains? Isn’t Akhara usually associated with (Lord) Hanuman?”
